1. Ownership of the Site

3. Regulatory Status & Research-Use-Only Products

Tested True Peptides LLC is not a compounding pharmacy or chemical compounding facility under Section 503A of the Federal Food, Drug, and Cosmetic Act and is not an outsourcing facility under Section 503B. We do not compound, manufacture, or dispense drugs for human or veterinary use. All products are for laboratory research use only and are not intended for human consumption, injection, inhalation, or application; use in food, drugs, cosmetics, medical devices, or veterinary applications; diagnosis, treatment, cure, or prevention of disease; or any clinical, medical, household, or commercial application. Misuse is strictly prohibited.

4. Chemical / Biological Hazard Notice

Products may pose chemical, biological, or physical hazards. You agree to handle all materials exclusively in controlled laboratory environments, use appropriate PPE and safety protocols, and comply with all applicable local, state, and federal laws.

5. FDA Disclaimer

Statements and products provided by Tested True Peptides LLC have not been evaluated by the U.S. Food and Drug Administration. All products and information are for educational and research purposes only. Tested True Peptides LLC is not a 503A compounding pharmacy or a 503B outsourcing facility. We do not diagnose, treat, cure, or prevent any medical condition.

6. Purchaser Responsibility & Assumption of Risk

By purchasing, you assume full responsibility for the lawful and safe handling, storage, and use of all materials; understand the inherent risks associated with research chemicals; acknowledge that Tested True Peptides LLC does not compound pharmaceuticals under 503A or 503B; and certify that you are at least 21 years old or the legal age of majority in your jurisdiction.

7. Waiver of Liability

To the fullest extent permitted by law, you waive claims against Tested True Peptides LLC, its owners, employees, suppliers, and affiliates for injury, loss, or damage arising from handling, possession, storage, use or misuse of products, or violation of these Terms, including direct, indirect, incidental, and consequential damages.

8. Indemnification Agreement

You agree to indemnify, defend, and hold harmless Tested True Peptides LLC from claims, liabilities, damages, or legal actions arising from your purchase or use of products, violation of these Terms, misuse or unlawful use of materials, or allegations of improper compounding or pharmaceutical use related to 503A or 503B.

9. Requirements for Using the Store

You represent that you are legally permitted to purchase research chemicals in your jurisdiction, will not use products for clinical or medical purposes, understand that we do not provide compounded medications, and will not resell or distribute products for prohibited purposes. We reserve the right to refuse service or cancel orders at our discretion.

10. Changes to Terms

Tested True Peptides reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page. Continued use of the website after changes constitutes acceptance of the updated Terms.

11. Termination of Contract

We may terminate or restrict access if you violate these Terms, misuse products, or attempt to treat products as drugs subject to 503A or 503B standards. Liability, indemnification, and intellectual-property provisions survive termination.

12. Limitation of Liability

Tested True Peptides LLC shall not be liable for indirect, incidental, special, punitive, or consequential damages or loss of business, data, or profits. Maximum liability is limited to the purchase price paid for the product.

13. Governing Law

These Terms are governed by applicable law, without regard to conflict-of-law principles.

15. Return and Refund Policy

All sales are final. We do not accept product returns or exchanges. Except for the qualifying third-party laboratory-testing exception described in our Refund Policy, we do not issue monetary refunds. Approved damaged, defective, incorrect, or confirmed lost-package claims may be resolved through reshipment or store credit. See the Refund Policy for complete claim requirements and exclusions.

16. Guaranteed Delivery

A $7.99 Guaranteed Delivery charge is added to each order to cover loss, damage, or delivery issues during transit. If an order arrives damaged or compromised, contact testedtruepeptides@gmail.com immediately with your order number and clear photographs. We will review the claim and arrange an appropriate replacement or resolution.

17. Entire Agreement

These Terms constitute the entire agreement regarding access to and use of the Site, including purchases, and supersede prior or contemporaneous agreements, communications, representations, or understandings, whether written or oral.

18. Severability

If any provision is held invalid, unlawful, or unenforceable by a court of competent jurisdiction, it will be severed and the remaining provisions will remain in full force and effect.

19. No Waiver

Failure to enforce any right or provision does not constitute a waiver. Any waiver must be in writing and signed by an authorized representative of Tested True Peptides LLC.

20. Electronic Acceptance

By accessing the Site, creating an account, or placing an order, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. Electronic acceptance has the same legal effect as a handwritten signature.
